RE: Conversion of Chattel property owned by the above captioned entities
Dear Occupant, and or Resident:
I represent the above captioned entities personally, and in all my legal capacities. This letter is to Notice you that the Jean E. Vorisek Family Trust has begun the process of reclaiming its real property located at 309 Waukewan Road, Center Harbor, NH 03226. Based upon newly discovered evidence that a fraud has been committed on the Belknap Superior Court, among other authorities, and the above named parties, in the process of the foreclosure: We have every right to believe that we will be successful in our case.
At this time, upon reason and belief, it is my understanding that you have converted the personal chattel property of the above captioned entities to use for your own purposes; and, that you have removed some of the personal chattel property from the subject premises, also without the legal owners consent, and without lawful justification.
At this time the above entities would request that you immediately recapture all of the personal chattel that you caused to be remove from the subject premises, and that you voluntarily allow the above entities to immediately recaption and take legal possession of the chattel property that is ‘in situ’, while you arrange for the return of the illegally removed chattel; and, while the real estate claim is being processed through the courts and other jurisdictions. In plan language, this letter is a request that you voluntarily and immediately vacate the premises so that the above entities can take all legal steps necessary to protect its chattel property in situ.
The law is clear: "A conversion may be committed by unreasonably withholding possession from one who has the right to it: ie. to refuse to surrender a chattel on demand to a person[s] entitled to lawful possession.
The law is also clear that mistake, good faith, and due care are ordinarily immaterial and cannot be defenses in an action for conversion. The defense of ‘authority of law’ disappears when that ‘authority’ was obtained by fraud, or perjury, or other illegal acts.
Considering the value of the converted chattel, still located on the subject premises and that which has been removed, I would expect that all of it is properly insured against any and all damage, theft etc. At this time it would behoove us all to attempt to mitigate what has already been established as substantial damages in the loss of use of the chattel property by its rightful owners, among other expenses that have been caused to be incurred by the act of conversion, to include any damage to the existing property that has already been suffered upon the taking and conversion.
If this request is not responded to forthwith, I will consider it a refusal.
